What’s Not Covered by Commercial Auto Insurance?

Learn about commercial auto liability coverage exclusions.

If your business requires the use of company vehicles or requires employees to travel for work in their own cars, then you need to secure the protection that only commercial auto insurance can offer.  Much like personal car policies, commercial auto insurance offers your staff liability, collision, and comprehensive coverage in the event that they get into an accident while completing business duties.  However, just like all insurance policies, your commercial auto policy is subject to certain limitations.  In particular, there are certain liability limits that you need to be aware of.  Here are some of the commercial auto liability exclusions you need to be wary of.

  • Expected or Intentional Injury

If you or an employee intentionally caused injury or property damage to a third-party with their vehicle, then this will not qualify for coverage under your commercial auto liability insurance.

  • Workers Compensation

Commercial auto liability insurance is designed to cover third-party injuries and damages.  This means that this type of insurance will not offer coverage for the injuries that your employees sustain in an auto accident.  These issues will be covered under your workers compensation, disability, or government insurance program depending on the specifics of the accident.

  • Employer Liability

If an employee is injured in a commercial auto accident and attempts to sue you for damages, your commercial auto liability insurance will not offer any coverage.  Typically, these claims are covered under your employers liability insurance.  Please note that there are two exceptions to this exclusion.  First, your commercial auto liability insurance will provide coverage for claims made by injured domestic employees who are not eligible for workers compensation benefits.  Second, you can secure coverage for liability you have assumed under an insured contract for claims made by injured workers.
